Truck from dealer won't pass inspection

So I bought my 08 from a dealer in PA. Im in MA. Truck has full deletes but none of the stock parts. I figured it would pass inspection just like my ford did when deleted. Turns out it won't pass. My question is would I be able to go after the dealer because the truck won't pass inspection because it has none of the emissions that are federally mandated. What do you guys think? I called them and they said they would get back to me….

I would think they are responsible for making it pass inspection. I know in colorado when you buy a truck from dealer they are required to have emissions done and it pass. When I got my truck the dealer skipped that and I got stuck with bill. I went and turned in my receipt from emissions test and made them reimburse me, and they fought it but once I reminded them i knew what I was talking about they ponied up and gave me my $60 back. Hopefully your dealer will make it right but look into laws for both states on dealers responsibilities should be on the motor vehicles website. Good luck

Make it right or take it back or (last choice) threaten to report them. They could be fined big time.
I would personally find a friend in a non testing county and register it there.
I think you just found the solution. I predict the dealer will be returning your truck to stock....make sure they don't keep the aftermarket parts...

I hate to say it but you might need a Lawyer. Since you bought the truck used and in most cases there is no implied warranty on used vehicles and they are sold as is. I do agree that the truck is legal to sell but it is buyer beware. So contact the dealer and keep all documentation between you and the dealer and the rejection of the emission compliance.

What it will come down to is whether there's proof the truck was deleted prior to the dealer selling it. If OP can prove it was sold with emissions systems deleted then the dealer will be obligated to put emissions back on it, and may even attract fines in the process.

What will get interesting is that the dealer may try to keep the aftermarket parts to offset their losses in restoring the emissions equipment.

OP, please update us with the final Resolution when/if.

This is the right answer. The Truck CANNOT be sold legally in the US without the emissions. The Dealer needs to make it right or risk stiff fines or even lose their license....

I agree that the dealer shouldn't have sold the vehicle unable to pass inspection and or deleted(against federal law)
That being said, are we not responsible for our own actions anymore? Huge problem today!

No flame here, just nodding in agreement...
Not to mention any legal action you take is just putting more attention in our court system on the fact that there are those of us in this community that are defeating federally mandated emissions controls on our vehicles, which will give the EPA and it's subsidieries even more ammo to continue to throw even more strict sanctions and penalties on everyone that is involved with emissions defeat, which will eventually fall on the end user.

Yeah I did know it was deleted, with that being said I asked the dealer if they had the stock exhaust system. He told me yes he would talk to the previous owner. Now he says he docent work at the dealer anymore and he can't get ahold of the guy. So I was lied to and now am taking action like any other person would. When I got the truck he said the guy was "out of the country for business trip" and he would be in touch with me. No Im not whining about it and I don't plan on making a big deal out of it. And nor did I buy it because it was deleted. It was the truck I have been looking for….

if you acknowledged that you knew it was deleted and bought it without any paper to back up your claims of rectification of the missing emissions stuff..... you lose.

My family owns a dealership. In Pennsylvania, if you buy a vehicle "as is" the only repercussion that you have to return said vehicle is if it has a severe safety issue(broken suspension component etc...). In that situation if the dealership will not work with you, then you definitely have to get the court system involved. Yearly inspections are for either safety or emissions. Some counties do not have emission inspections. If you purchased the truck from a non-emissions county then your s.o.l. If it was emissions inspected, I would go after the inspection station first (may be the dealer that you bought it from). Inspection station will be on back of insp. sticker.
I bought mine deleted from a dealer I wouldn't have bought it if it wasn't. If I had known more about the 6.7 I wouldn't have been looking for another 5.9 or deleted 6.7 but a truck I liked. After a little over a year I'm happy with my 6.7 well now that I have my Anarchy EFI Live.
