Just got a ticket..

So i was heading up to the lake for the weekend and i passed a highway patrol that was pulling someone over and i was only doing about 15mph on light throttle. I get about a mile down the road then here he comes catching up with his lights on and he comes up and says that my exhaust hurt his ears and he instantly gave me a ticket!!! its a joke..

did he even check the db level? or did he just give you one with no proof? thats a joke i would complain about that one
NO! no db or anything it makes me mad how he can just write me up without even checking! im going to complain this is dum... plus its my first ticket and ive been driving it like this for 6 months and as soon as i leave the county they get me for it...
Check your local and state government codes on exhaust system required, read the details and understand them, if you still feel like your citation was unjust then challenge the citation in court. Better to get a jury trail than a bench trail, you will be defending yourself to the common man, not just a judge who can only see black and white. You might have a case, but most of the time a citation like that is a fix and dismiss ticket, have a shop write you a note saying the repair was made or there was never an issue, then see if they will drop it. In Texas a muffler is required, I will post the Texas Statute, I am sure your state has something similar.

§ 547.604. MUFFLER REQUIRED[0]. (a) A motor vehicle shall
be equipped with a muffler in good working condition that
continually operates to prevent excessive or unusual noise.
(b) A person may not use a muffler cutout, bypass, or
similar device on a motor vehicle.

Acts 1995, 74th Leg., ch. 165, § 1, eff. Sept. 1, 1995.
You have a chance to fight it if you wish. Its like getting a DWI with out him doing a FST or alcohol content test.

He can't just give you a ticket for your exhaust with out proof that it is loud. Unless he has a DB meter built in to his ears he has no proof of how loud it is. He can how ever (if he is smart enough) write you for disturbing the peace. Check into your local laws and find out what you can do. Every local and state agencies have different statues on things.:thumbsup
good luck, when it comes to court he is a trained professional and has no reason to lie ,and you whats your defense?
The truck has no muffler.........that is illegal.Why would the officer have to measure DBs?:$::$:

If there is a noise ordinance, and your vehicle exceeds the dB level, they can write you up for that... since your muffler is MIA, he could have written a ticket for that, a fix-it. But there is no case if he wrote you a ticket because "the noise hurt his ears" and he didnt check the dB level...
Since he wrote you the ticket did you give er hell after he let you go? Just to show him what loud actually is.
damn cops, no offense to any on here, (you guys are the cool ones and know what a cummins with a straight pipe is all about). have fun with that one.
lol yea that would be funny but i could see getting re pulled over and him calling that reckless driving some how....lol.
I know here in california any exhaust modification is illegal (technically even a tip) and it is up to the officers discretion as to whether or not it is too loud. Some will hate it and pull you over to write you a ticket and others will pull you over and tell you it is cool. I had a conversation with the cop that pulled me over here in town (I was driving my crawler tacoma around with straight headers) and I asked him what he considered too loud, and he said that if its loud enough to set a car alarm off and wake him up in the middle of the night then its too loud :thumbsup

like bob said get over it :popcorn: :lol3: on the reall note though get a muffler installed and go take it to court say whatever he thought was loud is fixed now then go back home and pull the muffler they will drop the ticket if you fix it for the court.. Ive driven around with stacks on for about 2 years and the first time I went to newport oregon I got a in the first 5 min of being there for loud exhaust.. Some cops are like that.. Its scary knowing that the only things some of these cops worry about is what we drive.. just think of it this way he must own a powerstroke...

Yeah, its tree hugger central around here and I hate it. WHen I get a diesel I dont care if fuel goes over $30/gallon Im going to go around dumping soot on every tree huggers damn prius I see, it will be worth it
i think here in Pa a turbo is considered a mufflering device i have been stopped 1 time and he thought i didnt have an exhaust then i should the cop he said ok your good to go.. my truck is a staight piped 5in and dumps out infront of the rear tire.

ya pretty much california is strict on everything but im still going to see if i can fight for it cause the highway patrol around here are not as bad there pretty cool... if not il just throw my stock exhaust back on and take it in.

No dought i took off and hammered down. I showed him how loud it really was considering i basically idled by him... i was thinking about throwing on the smoke switch and leaving a 20ft black cloud trail down the road :lol3:
