Thats not true from what I know, but I am not a Texas state inspector. The exhaust has to exit past the passenger cab, and if you run it past the cab and thru the bed (stacks) it has to be taller than the cab. There can also be no obstruction forward the windshield so it fails both ways.Another post from Texas says it is legal, at least in that state as long as it is above the cab.
Check it out. It shows her truck blowing plenty of smoke out the one stack coming through the hood, with a flapper on it, no less.
