$590.00 fine yesterday for not enough license
-------------------------------------------------------------------------------- I want all of you to suffer through this. Here in North Carolina. I have 33k on my dually. 32k has been towing RV heavy. I have my truck tagged for 10k. RV towing is exempt on tag requirement in NC. I almost never tow a heavy utility trailer. Maybe 3 times a year. And this is intown. Never interstate or county driving. My daughter needed some crossties. I rented a 16' double axle trailer from local rental company. Had tie crane load 3 bundles of 8' ties on my trailer. No load for the truck but max for trailer. My wife and I drove 10 miles toward Charlotte and passed HP on entrance ramp to interstate. He immediately pulled out and caught up with me and pulled to my left rear I suppose to read my tag. He called it in and saw I had 10k tag. Would have been fine for towing my 16k RV but not this 9.9k trailer. He pulled me over and directed me to the next truck stop where he pulled out the scales and weighed each axle, measured length of front truck axle and center of trailer axles. He wrote me a ticket for 9900#s over my truck tag. He checked the GVW tags on trailer and truck. I was under the GVW ratings of rig but did not have enough tag weight. Cost me $590.00... He was not interested in GCVW... I found out these facts: For North Carolina @ this point forget RV towing Class C license You can drive truck up to 26k GVW You can drive truck up to 26k GVW and trailer to 10k GVW You can drive motor coach with GVW of 26k Class B license You can drive motor coach with GVW over 26k Class A license required for any truck with trailer over 10k GVW Class A license required for any truck with RV behind over 10k GVW Any truck pulling RV for recreation is not required to pull in weight station. If you are in truck and pulling an RV over 10k GVW and get stopped or go through license check and do not have Class A license you are subject to ticket. This has blown most of my thinking. We have beat to death GCVW and we do not need to legal wise. Safety wise (yes) He mentioned lawyers and accidents and liability. They look at GVWs of both vehicles not GCVW. Officer said this is the most misunderstood law out there. Not the issue of weight but the license you are required to have. Most accidents we are seeing are probably because of not being aware of your duty driving, Class C drivers like myself that might could ignore an accident if I went through training and getting Class A license. It might make me aware of a few dangers I have not heard of. OK, beat me up!!

Sorry to hear about your ticket. I don't think anyone is going to beat you up about it. Heck, I'll bet we are all guilty to some point of the exact thing you got nailed for. LT.

I was pulled over in Iowa with my truck and trailer and a State Trooper pulled in behind me the same way. Wanted to do a Level 3 examination on me and the truck and trailer. I asked him why and he started with this and that. Wanted to ask him if the examine required latex gloves. I informed him that the reason for my trip wasn't commercially related. He said he could push the issue, which I'm sure he could have, but was nice enough to let me go. On the way home I counted 5 trucks with small trailers pulled over at one time at one weigh station. At a fine like the OP's they have easy targets with pick-ups w/ trailers and the fines make quick, easy, and larger contributions to the states. Easier picking than speeders and such. A friend of mine repalced the brakes last month on his truck at the dealership, there was brake fluid residue on the front left and New York fined him $350.00. He sent a copy of the repair bill showing that the truck had been in the dealership the week before the ticket and they said he should have taken better care of his truck and thanked him for his contribution to the fine state of New York. Tom

Although ignorance of a law is not an excuse to break the law, how will the $590 fine better serve and protect us? There should be laws in place to have the rental company check the licence of someone utilizing their equipment. If you don't have the credentials...sorry, we can't rent to you. This might have grounds in a small claims court. Unless in the contract you signed a waiver fully understanding your responsability in regards to the state laws. ![]() Sorry you got the ticket. Thank you for sharing and letting the rest of us know what the "rules" are.

yep they are cracking down around here too, we got pulled over pulling a 28 ft tandem gooseneck, the first thing he did was tell me my radar detector was illegal and remove it immediatley and said i couldnt have it in a cdl truck, then he gave me a warning for no cdl. he said they are cracking down on hot shot rig's. around here they add you gvw's up if it exceeds 26K you must have a cdl.

When I first started in the rental business , my plates were for 10K. When I renewed them the next year , the lady at the BMV asked me how much my trailer and equipment weighed.(small town where everyone knows everyone) I told her most loads were around 12k. She suggested I get 22k plates so that's what I went to......she said the combined weight is what they would look at. I have never weighed the truck , but a Mega with a tool box and 50 gallon transfer tank would come in at around 8500 I would guess. I have never been stopped , but like some of you have said....with the states being broke , they're probably gona start cracking down.

I'm plated for 36k gcwr now. I used to have a 12k plate on the truck and 18k on the trailer, the trailer never had a weight issue but a couple times I weighed loaded the truck came in 12,600 or so.

They definately are cracking down on the "Hot-Shot's". Hot Shot rigs are easier for them to inspect(less vehicle) and there are alot of guys hauling commercially undercover. These two aspects add up to easy and big money if violations are uncovered. They are after someone hauling without a license, no d.o.t. #'s, plus overweight. CHA-CHING$$ I dont think you deserved a ticket for being over tag weight, specially if your not hauling commercially. I could understand a ticket for being dangerously over GVWR or GCWR. But just over your tag... that's petty!
