Westchester diesel shop?
Hey guys - I'm new to the site but also live in Westchester. Live in N. White Plains, work in Armonk, farm in Warwick (Orange County). I can't seem to find a diesel shop around here. Any ideas? Also, I had a BATTLE at DMV over my plates. They refused Ag plates because, "you just don't wanna pay no f'ing taxes"...Then, when I brought them a copy of the law, they agreed to the Ag, but since the truck weighed over 5500lbs, that superceded the Ag option. Commercial it is. |

The DMV rep does not know what the f--- they are talking about. There is no weight restriction on AG plates. I have a 34,000 truck with AG plates. They are confusing the passenger plate rule. If they won't budge, take your title, registration etc to an AG friendly DMV office (ie upstate), have them change your registration class. They should be able to refund your fees and taxes and issue a registration for the AG class. Also very important is that you follow up and fill out the correct forms so that you either do not pay sales tax or tiy get a refund for any tax you paid. If you use the truck for farming there is no sales tax. On a new truck this is a big nut. BTW personal transportation of the farmer and family is an acceptable use under the AG class. These should not be confused with the farm class where you are restricted to the farm, adjoining roads, sanitary landfill and repair shop.

Thanks - I will email you. I knew that they were wrong. I had the website from the farm Bureau printed out in front of me. I handed it to the DMV Mgr too. They just dug in and let me sit on the bench for 45 min, then told me flat out I was wrong and wasn't getting out of paying taxes. I told them that the tax issue was between me and the IRS - not the DMV. Finally, I folded. What's the difference between Ag, Farm and commercial? Sorry to get off topic. Should I start a new thread?

Ag is for any vehicle that is used by a farmer for farming type activities. Good statewide and in other states. Commercial is any vehicle used for commercial purposes or for people with pickups like us that cannot get passenger plates. Farm is for farm vehicles, good only on the farm, adjacent farms, route to the repair shop and nearest sanitary landfill. The main difference between the AG class and commercial is that for AG you are exempt from the heavy duty use tax, that are imposed by most counties. The only drawback to AG plates is that only 1 year registrations are available. You cannot get a two year expiration like the other classes. The sales tax issue is completely separate deal from the registration class. There is a tax form DTF-803 that must be filled out instead of the regular yellow sales tax form. This form should be used for any claimed exemption. If you claim a farming exemption you can select either passenger, commercial AG or farm plates. Sales tax is not mutually exclusive to AG registration class. The form is here NYS DMV - Forms Download Many registrants commonly misuse the forms and pay sales tax when they are not supposed to, for example if you move to NYS from another state. NY cannot charge you sales tax as you already paid sales tax to your previous state. If you buy a car or truck from family, they cannot charge you sales tax. If you build a trailer, you most likely paid sales tax on the components so NYS cannot charge you tax. Likewise goes for any vehicle used for farming, agriculture or interstate commerce. I am in Dutchess County and I have had no trouble submitting these forms, presumably because there are a lot of farms here. I have trucks, trailers, and boats. None of which I paid sales tax on. I use the boats for salt marsh restoration, in case you were wondering.
