Diesel Performance Products Inc. Wins Lawsuit
DIESEL PERFORMANCE PRODUCTS INC. WINS LAWSUIT The United States Court of Appeals for the Federal Circuit in Washington, D. C. unanimously ruled today (7-14-08) that the FASS does not infringe U. S. Patent No. 5,355,860, owned by Charles L. Ekstam. The ‘860 patent is licensed to Fuel Preporator International and Ekstam Worldwide, and sold as the AirDogTM. After the parties' oral arguments on Friday, the Court of Appeals affirmed, without comment, the St. Louis, Missouri district court's opinion, indicating that there was absolutely no uncertainty as to the outcome and bringing to a close a lawsuit filed over four years ago. Despite an appeal from the initial DPPI win in 2007, Diesel Performance Products, Inc has maintained its innocence to the allegations. DPPI's consistent position that its products do not infringe and are in fact superior to those of its competition is vindicated by this decision. Congrats!
Anytime you win it is a good thing, it's the amount of time that is wasted that sucks. You guys backed up my FASS when I had problems with it, without question. Great product, great customer service. I'll always have one on my truck. The new quieter version rocks, by the way.
